You must be at least 18 years of age to purchase or use a MOTAPAY gift card. By completing a purchase, you represent and warrant that you are at least 18 years old and legally able to enter into a binding agreement.
MOTAPAY gift cards are intended for use at participating Authorized Retailers. You are solely responsible for complying with all applicable federal, state, and local laws regarding the purchase and use of products obtained with a MOTAPAY gift card.
When you purchase a MOTAPAY gift card, you will be charged the face value of the card plus a non-refundable service fee. The service fee percentage is displayed at the point of sale before you complete your purchase and appears as a separate line item on your receipt.
Payment is processed through a third-party payment processor. MOTAPAY does not store your credit or debit card information.
At the time of purchase, the Authorized Retailer will verify that the name on your government-issued identification matches the name on your payment card. This verification is mandatory and serves to protect against fraud and unauthorized use.
Where applicable, the Authorized Retailer may collect your state-issued patient identification number at the point of sale. This information is recorded on the transaction record to comply with applicable state tracking and reporting requirements.
Your verified name and, where applicable, patient identification number are recorded on the transaction record for fraud prevention, chargeback protection, and regulatory compliance purposes. By completing a purchase, you consent to this identity verification, patient identification collection, and recordkeeping.
You are solely responsible for the safekeeping of your gift card. MOTAPAY is not obligated to replace, credit, or refund the value of any gift card that is lost, stolen, damaged, destroyed, or used without your authorization.
MOTAPAY gift cards do not expire. The value loaded onto your gift card will remain available for redemption at participating Authorized Retailers for as long as the MOTAPAY system is in operation.
MOTAPAY gift cards may be redeemed only at participating Authorized Retailers using the MOTAPAY payment system. Redemption requires scanning the gift card at the retailer's point of sale and authenticating with the PIN associated with your card (the last four digits of the payment card used at the time of purchase).
At the time of redemption, the Authorized Retailer may collect or confirm your state-issued patient identification number for regulatory compliance purposes, where applicable. This information is included on transaction records and may be exported for state-required reporting.
Gift cards cannot be redeemed for cash or used outside the MOTAPAY payment system. Gift card balances may only be redeemed at participating merchants. Partial redemptions are permitted; any remaining balance will stay on the card for future use.
MOTAPAY gift cards are backed by $NUGS digital tokens on the Polygon blockchain. Each gift card is pre-loaded with tokens before it is made available for purchase. You may verify that a card is fully funded before buying by scanning the public wallet QR code printed on the package, which allows you to view the card's token balance on the Polygon blockchain. A service fee is applied to every gift card purchase. This fee is clearly disclosed and displayed as a separate line item at the point of sale before payment is processed. The service fee covers payment processing, card production, and system operation costs. The service fee is non-refundable.

Fraudulent chargebacks — including chargebacks filed after voluntarily completing a purchase with valid identity verification — may result in investigation and, where applicable, referral to law enforcement. MP Labs LLC, its affiliated entities, and authorized MOTAPAY independent sales organizations reserve the right to pursue all available legal remedies in the event of fraudulent chargeback activity.

The MOTAPAY payment system, including its methods, processes, and technology, is patent pending. All trademarks, trade names, logos, and intellectual property associated with MOTAPAY are the property of MP Labs LLC. Unauthorized use is strictly prohibited.
To the maximum extent permitted by applicable law, MP Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your purchase or use of a MOTAPAY gift card, including but not limited to loss of gift card value due to theft, loss, or damage.
In no event shall MP Labs LLC's total liability exceed the face value of the gift card(s) at issue.
MOTAPAY gift cards and the MOTAPAY payment system are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
MOTAPAY does not guarantee uninterrupted or error-free operation of the payment system. Temporary service interruptions may occur for maintenance, updates, or circumstances beyond our control.
You agree to indemnify, defend, and hold harmless MP Labs LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use or misuse of a MOTAPAY gift card, your violation of these Terms, or your violation of any applicable law.
We reserve the right to modify these Terms at any time. The updated version will be posted at motapay.io/terms with an updated effective date. Your continued purchase or use of MOTAPAY gift cards after changes are posted constitutes your acceptance of the revised Terms.
Your use of the MOTAPAY system is also governed by our Privacy Policy, available at motapay.io/privacy. By using MOTAPAY, you consent to the collection and use of your information as described in the Privacy Policy.
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and MP Labs LLC regarding your use of the MOTAPAY payment system and supersede all prior agreements and understandings.
